The Diligent Search Tool walks you through the necessary steps of a diligent search. You will be requested to provide information and to answer questions regarding the work and its possible right holders. To respond to some of the questions, you will need to search appropriate external sources.
Choose the country in which you want to carry out your diligent search and then follow the decision process. At the end of the process, you will be able to determine whether your work is an orphan work under the Directive 2012/28/EU law as implemented in that country. Your downloadable search report can be used by any eligible Institution to record the work to the Orphan Works Database at the European Intellectual Property Office.

Questo strumento ti guida attraverso i passi necessari per compiere una ricerca diligente. Ti sarà chiesto di inserire informazioni e di rispondere a domande relative all’opera in oggetto e ai potenziali titolari dei diritti. Per rispondere ad alcune di queste domande dovrai eseguire una ricerca su apposite fonti esterne.
Scegli il paese nel quale intendi eseguire la ricerca e segui il processo decisionale. Alla fine del processo sarai in grado di determinare se l’opera in oggetto è un’opera orfana secondo la definizione della Direttiva 2012/28/EU, così come recepita nella legislazione di quello stato. Il rapporto sulla tua ricerca diligente potrà essere scaricato e utilizzato da ogni istituzione autorizzata per registrare l’opera nella Banca Dati delle Opere Orfane presso l’Ufficio dell’Unione Europea per la Proprietà Intellettuale.

Het rapport van uw onderzoek kan worden gedownload en gebruikt door elke onder de richtlijn begunstigde instelling om het werk te registreren in de ‘Databank verweesde werken’ van het Bureau voor intellectuele eigendom van de Europese Unie (EUIPO).
